GSC Estimating Portal — End-User License Agreement
Effective date: October 14, 2026.
1. Provider and scope
Growth State Consulting ("GSC," "we," or "us"), 182 Willow St, Stoughton, Massachusetts 02072-1029, provides GSC Estimating Portal (the "Service") to authorized business users. Contact: marco@growthstateconsulting.com.
This agreement governs use of the Service. A separately signed GSC services agreement controls pricing, service commitments, and any conflicting negotiated terms. It does not replace a contractor's agreement with its customers.
2. License and authorized use
GSC grants you a limited, nonexclusive, nontransferable right to access the Service for the business you are authorized to represent, while your access remains active and you comply with this agreement. GSC retains ownership of its software and templates. You retain rights to information you supply and your business records.
You must have authority to provide customer information and connect each business account. Use only the environment assigned to your business. Protect your login, notify GSC of suspected unauthorized access, and do not share credentials with unauthorized people.
Do not bypass access controls, attempt to access another client's records, disrupt the Service, submit unlawful content, or use the Service to violate privacy or other rights.
3. Features and human review
Depending on enabled integrations, the Service can prepare contacts, opportunities, estimate scopes, estimates, and billing actions. It can help interpret Portuguese and English instructions and expand scopes using company-approved defaults. Features may differ during the pilot; planned features are not guaranteed to be available.
AI output can contain errors. You are responsible for reviewing customer identity, property address, scope, materials, quantities, allowances, exclusions, prices, dates, taxes, payment terms, recipients, and all other content before approving an action. Standard scopes must be appropriate for the actual job and your company's practices.
A quoted estimate is not a guarantee of code compliance, engineering suitability, licensing, profitability, or contractual enforceability. The Service does not replace professional accounting, legal, engineering, or construction judgment. Approval of an estimate is not automatically evidence of a separately signed construction contract.
4. Connected services and permissions
The Service may work with HighLevel, QuickBooks Online, OpenAI services, and hosting providers. Their availability and terms also apply. QuickBooks access begins only after the appropriate company authorizes the integration. The integration may require broader accounting permissions than the individual estimate task; its actual use must match the disclosed functionality.
You authorize GSC to process your instructions and business information to provide the enabled Service and carry out actions you approve. Third-party actions may trigger workflows configured in the connected business account. An interruption can occur after an external action succeeds; check the relevant system before retrying to avoid duplicate records.
Disconnecting an integration stops future authorized access once disconnection is processed, but does not delete records already created in the external service. Third-party subscriptions and transaction fees remain governed by those providers and your agreements with them.
5. Privacy and data requests
The GSC Estimating Portal Privacy Policy describes processing of personal and business information. You must provide required notices and permissions for customer information you submit. Contact marco@growthstateconsulting.com for access, disconnection, or deletion requests. GSC may verify identity and business authority before acting.
6. Fees
Fees for GSC services, if any, are specified in a separate written agreement. This agreement alone does not enroll you in a paid plan or authorize a charge. You remain responsible for subscriptions or fees you separately authorize with third-party providers.
7. Availability and termination
GSC may update features and suspend access for security, unlawful use, nonpayment under a separate agreement, or material breach. GSC will provide reasonable notice where practicable; immediate action may be necessary for security or legal reasons. You may stop using the Service and request termination and disconnection through the contact above. Arrange export or preservation of needed records before ending service.
8. Warranty and responsibility
To the extent permitted by applicable law and subject to any separate written agreement, the pilot Service is provided as available, without a guarantee of uninterrupted operation, error-free output, or suitability for a particular purpose. Neither this agreement nor a disclaimer limits rights or liabilities that cannot lawfully be limited, including obligations imposed by applicable data protection law. Responsibility for a dispute will be determined under applicable law and any separate services agreement.
9. Governing law and changes
Massachusetts law governs this agreement, subject to mandatory applicable law. GSC will communicate material changes before they take effect where required. Changes do not retroactively authorize new charges or previously unauthorized data uses. Contact GSC if you do not agree to a proposed change.
